what is A NOTARY PUBLIC?

A Notary Public is a government officer and public servant who serves as an impartial witness in talking acknowledgments, administering oaths and affirmations, and performing other acts authorized by law. These official acts are called notarizations or notarial acts.

When documents are notarized, the public can be assured that its signer is not an imposter and any contracting parties can be assured that the document they have signed will have full force and effect.

A notarized document is considered "self-authenticating." The same is true under the rules of evidence in effect in each state.

When a document is self-authenticating, the signers of the contract do not need to testify in court to verify the authenticity of their signatures. That saves a lot of time and money. Having a document notarized is, "a huge strategic advantage" in litigation.

what is a notary signing agent?

A Notary Signing Agent or (NSA) is a Notary who has special training to handle loan document signings. Title companies and signing services hire NSAs to deliver loan documents to borrowers, oversee the signing and return documents to the appropriate party.

Notary public vs loan signing agent

All loan signing agents (LSAs) are notaries — but not all notaries are signing agents. Becoming an LSA requires additional certification and training. The job of a notary is fairly limited in scope, so they stamp a wide variety of documents. On the other hand, LSAs are trained to process loan documents specifically. The mortgage and financial services industries tend to involve more complicated and sensitive transactions, which is where the expertise of an LSA becomes valuable.

Like a notary, LSAs may not offer legal advice, clarification of terms, or interpretation of the documents they assist with. They are simply brought in at the final stages of the loan to assist with document handling and processing. And because LSAs receive access to private financial information about borrowers, they are required to undergo background checks on an annual basis. This prevents mortgage fraud and helps keep consumers’ information secure. In addition to these periodic background checks, LSAs are trained to process loan document packages. This involves printing loan documents correctly, using a mailing service to return signed documents, and following any additional instructions required by the lender or title company.
